
Brian Walters had denied rape and two counts of indecent assault but was convicted by a jury in 2023
A Hull man who was convicted of raping a woman has died in prison. Brain Walters was 67 years old when he was sentenced in July 2023.
Judge Mark Bury told Mr Walters he had plied the victim with drink “to the point where she was incapable of looking after herself”. The victim told Hull Crown Court she was “out of it” and “could hardly stand up” after sharing nearly 30 cans of Fosters lager with Mr Walters.
The victim said she recalled Mr Walters having sex with her but could not remember much about what happened. “I can’t remember how I came to be naked but I was fully naked,” she said.
She reported what had happened to a support officer and was described as “visibly upset” at the time. The police were alerted.
Mr Walters said there was “no truth” in the allegations and denied rape and two counts of indecent assault. He admitted he had been drinking, but added: “I had some beer. Fosters. I don’t count them. I just drink them.”
He claimed that it was not 30 cans between them, however. He was found guilty by the jury and imprisoned at HMP Littlehey, a Category C prison in Cambridgeshire.
Mr Walters, who was on bail during the trial, had been remanded in custody ahead of his sentencing hearing after being convicted of the offences. Charlotte Baines, mitigating, said he was “struggling to cope” with custody.
He died in hospital of a heart attack caused by atherosclerosis, a condition where fatty deposits build up in the arteries and cause them to narrow, on October 27 last year, age 68. A report into his death was published by the Prison and Probation Ombudsman (PPO) last Friday (November 7).
NHS England commissioned an independent clinical reviewer to review Mr Walters’ clinical care at HMP Littlehey. She found his care was of a “good standard” and “equivalent to that which he could have expected to receive in the community”.
The PPO investigator examined the non-clinical issues relating to Mr Walters’ care. No non-clinical issues were found and the Ombudsman said it made no recommendations.
